5th Annual Woodstock Fine Art Auction to benefit the Woodstock Artists Association and Museum Sunday, September 2, 2007 at 2pm EST. The Woodstock Artists Association and Museum (WAAM) acts as agent for various consignors.  The WAAM is not acting as agent for the bidder or buyer.  The WAAM and the James Cox Gallery (JCG) at Woodstock (co-sponsor) have taken care to describe and depict all items fairly and accurately, but take no responsibility regarding authenticity, condition, or description.  Descriptions may be altered at any time by notice or announcements.

 

Bids made in person, by telephone, online, by agents or in written form may be submitted to the auctioneer.  All buyers will be bound by all conditions of sale. Bidding on any item indicates acceptance of the following terms.

 

Terms and Conditions of Sale

1) REGISTRATION:  Bidders in attendance, phone bidders and absentee bidders must register with either WAAM or the James Cox Gallery and complete the appropriate paperwork at least one hour before the auction start time. Online bidders must register with eBay Live before bidding.  Proper identification will be required.  Auctioneer reserves the right to refuse to register any prospective bidder for any reason.

 

2) BUYER PREMIUMS: All eBay Live Auction bidders are subject to a standard 15% buyer’s premium which will be added to the hammer price for each lot sold on eBay Live Auctions.

-All Auction absentee bidders (bidders leaving order bids) and buyer’s bidding via telephone will bid subject to a 15% buyer’s premium.

-All bidders in attendance will be subject to a 15% buyer’s premium.

 

3) Buyers in attendance are required to pay for and remove all items on the day of the sale.  Special arrangements may be made in rare circumstances to pick up sold pieces at the James Cox Gallery in Willow, NY after Tuesday the 4th of September.

 

4) PAYMENT: Internet sales must be paid for within 5 BUSINESS DAYS of the sale or Seller may void sale.  Please do not make payment until you have received an official invoice from James Cox Gallery.  Acceptable forms of payment include MasterCard and Visa.  Charge Cards may also be accepted via the internet through PayPal sent to pay@jamescoxgallery.com and only when address can be verified. 

 

Buyers in attendance may make payment in cash, VISA or Master Card or with approved check.  Internet buyers who have established accounts with the James Cox Gallery may make payment with approved check.

 

New York State sales tax must be charged (8% in Ulster County) unless the buyer has a fully completed tax certificate on file prior to auction.

 

5) The highest bidder acknowledged by the auctioneer shall be the buyer.

In case of a dispute the auctioneer shall determine the buyer or re-open the bidding process to settle the dispute.

In the case of tie bids between an online bidder and a bidder in attendance, the bid from the bidder in attendance shall win.

The auctioneer will set the bidding increments in accordance with the value of the item and the rules of Ebay. The auctioneer may reject any bid representing a fraction of the increment being called for or any bid not commensurate with the item’s value.

 

6) The final auction invoice shall be supplied by the James Cox Gallery.  All other information should be considered preliminary.

 

7) Once property is sold it becomes the buyer’s responsibility.

 

8) Pre-sale estimates are intended to be rough guides of value and do not necessarily reflect actual value or hammer price.

 

9) Reserves are in some cases set by sellers as a confidential minimum that must be met before an actual sale is consummated.  Lots with reserves are indicated in the catalogue.  No reserve is higher than the low estimate.

 

10) The WAAM and the James Cox Gallery reserve the right to withdraw any lot from the sale at their discretion.

 

11) Bidders may also bid by phone during the live auction.  It is recommended that phone bidders call at least one day ahead of the sale to register and arrange for phone bidding.  Phones are limited and available only to the limit of our equipment and personnel.  To register for phone bidding please call 845-679-7608 or 845-679-2198.

13) All property is sold “AS IS.”  All sales are final.  No returns are accepted.  Descriptions of size, condition, subjects, dates etc are made to the best of our knowledge.
